Delhi High Court on Tuesday stayed Arvind Kejriwal's bail order passed by the trial court. Delhi HC allowed the Enforcement Directorate's plea to stay the trial court's bail order for Delhi Chief Minister Arvind Kejriwal in the money laundering case linked to the alleged money laundering excise scam.
The bench of Justice Sudhir Kumar Jain stayed the Arvind Kejriwal bail order granted by the trial court on June 20. The bench had reserved the order on June 21 after the agency challenged the trial court's decision, which has been put on hold until the ruling. Meanwhile, the Court has already fixed the main matter for July, where ED challenged the trial court order granting Arvind Kejriwal regular bail in the case.
Justice Sudhir Kumar Jain allowed the application moved by the Enforcement Directorate (ED) seeking stay of the trial court's order. As per LiveLaw, the Delhi HC observed, "This court has decided that the vacation judge did not appropriately appreciate the material on record and the averments of ED."
The Delhi HC objected to the trial judge's observation that the entire voluminous record was not perused. Such an observation was "totally unjustified" and showed that the trial court has not applied its mind to the material.
For the unversed, AAP National Convenor Arvind Kejriwal was granted bail by the trial court on June 20. On June 21, ED moved the Delhi High Court challenging the grant of bail to the Chief Minister. In the interim, the central probe agency moved urgent application seeking stay of Kejriwal's bail order.
