New Delhi: The Delhi High Court has instructed a local court to make sure that the litigation in a 2010 murder case, in which a 22-year-old man was killed, is not unnecessarily detained.
Justice A.K. Chawla also asked the trial court Judge to see to it that no needless adjournments are granted in the case. The High Court order came on an appeal by the father of the victim Umesh Singh, entreating a speedy trial in his son murder case in which the charge sheet was filed eight years ago.
The father barrister had put forward that the case was listed 37 times before the trial court and it was being loitered on account of non-availability of either the accused persons’ counsel or the Special Public Prosecutor.

The High Court also asked the police to file an additional status report regarding the implementation of a non-bailable warrant furnished by the trial court against an accused who had failed to appear before it. It also dictated the investigating officer (IO) and Station House Officer (SHO) to remain present before the court on May 30, the next date of hearing.
The police remarked and assured of the examination of all the prosecution witnesses in the case by the trial court. A status report handed over by the trial court Judge stated that one of the accused, Praveen Nagar, absented on the last hearing and NBW has been issued against him.
According to the beseech, Kamal, a Delhi University student, was assassinated by five people near a gurudwara in Sonia Vihar in north-east Delhi on July 12, 2010. The casualty was taken to GTB Hospital where he was announced dead.
The police had remarked that 76 injuries were foisted on the victim head, legs and hands with a sharp and blunt object. The plea said because of the non-cessation of the trial and adjournments being sought by parties, the rights of the victim father have been greatly bigoted and have caused a collapse of justice.
