After he spent 35 days in jail for a joke, as per reports that he didn't crack, Faruqui gets bail by a three-judge bench led by Justice Rohinton Fali Nariman. The bench also stayed a production warrrant issued by the Uttar Pradesh government against the comic.
The bench ordered, "The petitioner is released on ad-interim bail on conditions to the satisfaction of the trial court. In the meantime there shall be stay of the production warrants as well."
The allegations against Faruqui are vague, as per Justice Nariman. He also observed that the Police didn't comply with the lawful procedure prescribed under section 41 of CrPC.
Faruqui is accused of hurting religious sentiments. Justice Nariman asked, "tell us, Mr Kirpal, did the police follow Section 41 before they arrested him?" Mr Kirpal while responding to the Justice Nariman said, "No, My Lord....not at all."
Justice Nariman granted Faruqui bail before issuing a
