Mr Kundra, the husband of Bollywood actress Shilpa Shetty, had petitioned the Supreme Court after the Bombay High Court denied his request for anticipatory relief on November 25.
In his plea to the High Court, Mr Kundra said that the movies, while sensuous, did not reveal any physical or sexual activity. He further stated that he was wrongfully accused in the case and that he was not engaged in the creation or broadcasting of such recordings.
In the same case, the High Court denied anticipatory bail motions from five additional defendants in the original pornography case from last year.
Poonam Pandey and Sherlyn Chopra were among them.
Mr Kundra was detained in July as part of a Mumbai Crime Branch investigation into another matter.
He was detained for reportedly making and distributing pornographic videos using the 'Hotshots' subscriber-driven smartphone app. In September, he was granted bail in that matter after paying a Rs 50,000 bond.
Mr Kundra had filed that bail motion in the Metropolitan Magistrate Court, claiming that the prosecution had shown no proof linking 'Hotshots' to the authorities' accusations that it had been used for uploading and broadcasting obscene content.
There was also no proof that the businessman was "actively" involved in the development of the purportedly problematic information, according to the businessman.
Mr Kundra also alleged, as he did before the Bombay High Court in November, that he was wrongfully accused and that he was being made a "scapegoat" for reasons that are best known to investigators.
