The Crime Branch of Mumbai Police has arrested actor Shilpa Shetty's husband and businessman Raj Kundra. A case was registered against Kundra in February this year for creating pornographic content and broadcasting it through the app. He has been arrested in this case. In such cases, a case is often registered against the accused under sections of the IT Act and IPC. If the court finds the accused guilty, he may have to spend several years in jail.
We have very strict laws regarding pornography and pornographic content. In such cases, along with the IT Act, many sections of the Indian Penal Code i.e. IPC are also written against the accused. After the Internet technology goes vast, the IT Act was also amended. This is done for a casuse that in today's time if the person found guilty in such cases then he/she should be punished strictly.
The trade of pornography through the Internet is also booming. In such a scenario, pornography has become a big business. Which includes photos, videos, text, audio and material based on sex, sexual acts and nudity. The Anti-Pornography Law applies to such illegal material being published electronically, sent to or transmitted through any other means.

Nude or porn videos comes under the preview of this law. People who prepare nude or obscene videos of others or who make such MMS or transmit them through electronic means to others and send obscene messages to someone against their will comes under such offense. It is illegal to publish, transmit and transmit pornography to others by electronic means, but viewing, reading or listening to it is not considered illegal. But in case of child pornography, watching child porn videos is also considered illegal and could lead a person to harsh punishment under the act.

Punishment under IT Act and IPC
There is a provision of punishment under Section 67 (A) of the IT (Amendment) Act 2008 and Section 292, 293, 294, 500, 506 and 509 of the IPC in the cases falling under it. The first offense can be punished with imprisonment of up to five years or a fine of up to Rs 10 lakh, but for the second time offense, the imprisonment term may extend to seven years.
