SC refuses stay on 10% EWS Quota

Supreme Court taking into consideration the 2 petitions challenging the Constitution Amendment Act 2019 said that it will examine the matter

On Friday, the Apex Court refused the stay on the implementation of 10% quota to the economically weaker in general category saying , "we will examine the matter".

A bench headed by the Chief Justice of India Ranjan Gogoi and comprising of Justice Sanjiv Khanna will hear the matter in four weeks. "We are examining the matter and hence issuing notice returnable within four weeks", the bench said.

There arw several petitions in the apex court which challenge the Constitution Act 2019 including those from NGO Youth for Equality and Political Activist Tehsheen Poonawalla.

The petition by Youth For Equality stated: "By way of the present amendments, the exclusion of the OBCs and the OBCs and the SCs/STs from the scope of the economic reservation essentially applies that only those who are poor from the general categories would avail the benefits of the quota. Taken together with the fact that the high creamy layer limit of Rs 8,00,000 per annum ensures that the elite in the OBCs and SCs/STs capture the reservation benefits repeatedly, The poor sections of these categories remain completely deprived."

Meanwhile, Poonawalla has argued that backwardness for the purpose of reservation cannot be defined by "economic status alone"

Several states have already implemented the quota, including Gujrat and Himachal Pradesh.
