Hearing of Kolkata's doctor Rape & Murder case took place in the Supreme Court on Tuesday and the Chief Justice of India (CJI) Chandrachud highlighted the issue of women's safety. The Supreme Court had taken a suo motu cognizance of the recent horrific rape and murder of a 31-year-old doctor in Kolkata's RG Kar Hospital. A Bench of Chief Justice of India (CJI) DY Chandrachud and Justices JB Pardiwala and Manoj Misra were also part of the Bench that heard the case. CJI Chandrachud revealed why the Supreme Court had to take suo moto cognizance despite the fact that the hearing is already taking place in Calcutta High Court. Furthermore, CJI Chandrachud highlighted how denying safety to women in workplaces is a direct attack on their equality. Below are a few top quotes by the Supreme Court in RG Kar's doctor rape & murder case-

  1. "Why we decided to take suo motu though High Court was hearing it because this is not just a case of a horrific murder in the Kolkata hospital...but this is about systemic issue about safety of doctors across India."
  2. ..the young doctors have to put in long hours...no separate rest and duty room for men and women doctors. We need to evolve a national consensus for a standard national protocol for safe conditions of work. Ultimately what is equality under the Constitution if women cannot be safe in their workplace?"
  3. "After the crime was detected in the early hours of the morning, the Principal tried to pass this off as a suicide, and parents were not allowed to see the body."
  4. "But until late at night, there is no FIR saying it is a clear case of murder? How did the Principal try to pass this off as a suicide? The body was passed to parents in evening for cremation...then next day doctors are protesting and a mob invaded the hospital and critical facilities were damaged. What was Kolkata Police doing? The crime scene is in the hospital. Police has to protect the crime scene."
  5. "7,000 people cannot enter a place without know how of the police."
  6. "CBI needs to file a status report on this Thursday and let it apprise us about the status. Since it is sensitive stage, let it be given only to us. Today we will pass an order."
  7. The court expressed concern that the victim's identity has been revealed on social media. Her dead body has been shown. The CJI said, everywhere we saw that the victim's identity has been shown, whereas this should not happen.
  8. "Who lodged the FIR first and when?" asked SC.  On this, the court was told that the first FIR was lodged at 11.45 PM that night.
  9. CJI said that the FIR was lodged 3 hours 30 minutes after handing over the body to the parents? CJI reprimanded the West Bengal government and the hospital administration saying that why was the FIR lodged so late? What was the hospital administration doing?
  10. CJI then said, "we urge the doctors to return to work. We appeal to the doctors. We are here to ensure their safety. We will not leave it to the High Court. This is a matter of great national interest."

Finally, the Supreme Court also constituted a 10-member National Task Force for looking into ways to prevent gender-based violence against all medical professionals.
